It is permissible to have intercourse with a female captive after it is established that she is not pregnant, and if she has a husband, then her marriage is annulled when she is captured

This hadith has been narrated on the authority of Hisham with the same chain of transmitters (and the words are):

" The brother of Abu'l-Qu'ais sought permission from her ('A'isha) (to enter the house). The rest is the same.

ARABIC

وَحَدَّثَنِي أَبُو الرَّبِيعِ الزَّهْرَانِيُّ، حَدَّثَنَا حَمَّادٌ، - يَعْنِي ابْنَ زَيْدٍ - حَدَّثَنَا هِشَامٌ، بِهَذَا الإِسْنَادِ أَنَّ أَخَا أَبِي الْقُعَيْسِ، اسْتَأْذَنَ عَلَيْهَا ‏.‏ فَذَكَرَ نَحْوَهُ ‏.‏
